What is the Difference Between Federal Prison and New York State Prison?

A prison is an institution that confines persons who have a remand imposed by a judicial authority or are deprived of liberty because of a criminal conviction. Felony or misdemeanor offenses usually qualify for an incarceration sentence. In the state of New York, the Department of Corrections and Community Supervision has the charge of managing state prisoners in custody for the duration of their sentence. In essence, the agency is responsible for convicts under state law.

The Federal Bureau of Justice operates a criminal justice system at the federal level. Persons found guilty of contravening federal criminal laws are served sentences in confinement. The Federal Bureau of Prisons enforces these sentences by containing the convicts in standard facilities across the federation. Although state and federal correctional institutions are alike in principle, they differ in many ways:

  • State prisons are under the sole administration of the New York state government. Federal Prisons are under the management of the federal authorities. They do not share facilities unless a federal prisoner is in transit and must be kept in state prison.
  • State prisons in New York are likely to be more populous because of the reality of misdemeanor offenses that may warrant imprisonment. This adds to the overall caseload of the prison facilities. Federal prisons are limited to only federal crimes, usually misdemeanors.
  • The day-to-day operations and guidelines for correctional institutions at each level are based on the underlying law's guidelines. It means that the management of state correctional facilities is based on New York State laws, while federal prisons are based on federal law.
  • Most prisoners in state correctional institutions enjoy the possibility of parole upon good behavior. The Sentencing Reform Act of 1984 eliminated the possibility of parole in federal correctional institutions. At its best, incarcerated persons can look forward to reduced terms.
  • The construct of the state definitions of crimes and misdemeanors (violent and property crimes) selects violent convicts; hence, state prisons may contain more dangerous prisoners than federal prisons. Federal law definitions usually select less violent criminals, such as persons charged for white-collar crimes.

New York County Jails

County jails are temporary custody facilities reserved for persons arrested by the local police or awaiting trial in the state courts. These facilities provide for persons sentenced for misdemeanor offenses, usually short-term (less than one year) - most of these facilities house female and female inmates. How Does the Federal Prison System Work?

The Federal Bureau of Prisons is a nationwide network of incarceration facilities reserved for federal prisoners. The facilities are classified into minimum, low, medium, high, and administrative security levels. This classification makes provisions for the whole spectrum of violence in prisoners.
